Terms and Conditions – Styling Services

1. Service Validity

All personal styling services, including consultations, virtual styling sessions, wardrobe edits, personal shopping, personal styling packages, coaching services and bespoke styling packages, must be commenced and completed within 12 months of the original purchase or booking date, unless otherwise agreed in writing by Capsule Closet Stylist.

This 12-month period is the validity period for the service. It does not create a right to cancel or obtain a refund at any point during the 12-month period.

Capsule Closet Stylist reserves the right to determine the reasonable sequence and timing of the different stages of a styling package according to the client’s requirements, availability, the information provided by the client and the nature of the service.

2. Expired Services

If a service is not booked, commenced or redeemed within 12 months of the original purchase date, it will be considered expired.

Clients are responsible for arranging and attending appointments and completing the relevant stages of their service within the 12-month validity period. Availability is limited and last-minute requests cannot be guaranteed.

No extension will be granted unless agreed in writing by Capsule Closet Stylist before the expiry date.

Where a service has expired because the client has not arranged or completed the service within the applicable period, no refund will be due solely because the service has expired, subject always to any statutory rights that cannot legally be excluded or restricted.

3. Bespoke Services, Colour Analysis and Style Guides

At Capsule Closet Stylist, our services are bespoke and are adapted to the individual client. However, different stages of the service have different purposes and levels of personalisation.

Colour Analysis

Colour analysis is individually tailored to the client’s colouring and is intended to provide personalised guidance on colours, tones and combinations that are considered suitable for the individual client.

Style and Body-Shape Guides

Style, body-shape and silhouette guides are bespoke in the sense that they are adapted to the client’s individual body shape, proportions and relevant styling considerations.

However, these guides are not intended to represent the client’s personal taste, complete wardrobe requirements or finished shopping recommendations.

Their purpose is to demonstrate, through examples and imagery, the types of shapes, cuts, silhouettes, proportions and styling approaches that may be particularly flattering or appropriate for the individual client.

The images used in these guides are illustrative examples of styles, shapes and cuts. They are not necessarily intended to reflect the client’s personal taste, nor are they intended to constitute a shopping list or recommendations for the client to purchase at that stage.

A style guide should therefore not be interpreted as a finished personal style book or as a selection of items which the client is expected to purchase.

This distinction is important because a genuinely personalised style direction requires sufficient information about the client’s individual preferences, lifestyle, wardrobe, requirements and taste.

4. Client Responsibilities

The client is responsible for providing accurate and sufficient information to enable Capsule Closet Stylist to understand their personal style, preferences, lifestyle, wardrobe requirements and any relevant likes or dislikes.

Where a service includes a lookbook, style direction or personalised recommendations, the client is responsible for providing sufficient information and imagery before this work is undertaken. This may include completing any relevant style exercises or questionnaires, providing a suitable Pinterest board or equivalent collection of images, and providing any other information reasonably requested as part of the styling process.

Please ensure that the information and imagery you provide accurately and sufficiently represents your personal style before your lookbook is created. Lookbooks are bespoke, time-intensive pieces of work and are created based on the information you provide. You are responsible for providing sufficient information to enable us to understand your style, preferences, lifestyle and requirements.

A small, limited or narrowly focused selection of images may not provide sufficient information to establish a client’s wider preferences. Clients should therefore provide a representative range of imagery where requested.

If the information provided is insufficient to create the lookbook or other personalised work with a reasonable understanding of the client’s requirements, Capsule Closet Stylist may request further information before the relevant work is commenced.

Capsule Closet Stylist will base recommendations on the information provided by the client and cannot be responsible for preferences, requirements or dislikes that have not been communicated or adequately represented in the information supplied.

Lookbooks are not an open-ended process of repeated revisions to establish preferences that were not communicated or adequately represented at the outset.

I think this is much better protection for you than the previous version because it establishes three important things:

5. Development of Personalised Recommendations

Personalised styling recommendations are developed progressively throughout the service.

The level of personalisation may therefore increase as Capsule Closet Stylist obtains further information through consultations, wardrobe reviews, style exercises, feedback, shopping appointments and other stages of the service.

A client should not expect the earliest stage of a package to contain the same level of personalisation as recommendations developed after Capsule Closet Stylist has had the opportunity to gather comprehensive information about the client’s individual taste, lifestyle and wardrobe.

Where a client purchases an additional or subsequent service, such as a bespoke lookbook, personal shopping or Premium Styling Package, the client may be required to provide additional information to enable that service to be delivered appropriately.

Capsule Closet Stylist may request additional information before undertaking a highly personalised stage of the service.

Where the information provided remains insufficient, Capsule Closet Stylist will use its professional judgement based on the information available.

6. Changes to the Normal Process and Accelerated Requests

The normal sequence of a styling package is designed to allow sufficient time for consultation, information gathering, analysis and development of personalised recommendations.

Clients may request that stages are completed in a different order, brought forward or completed more quickly than the normal process.

Capsule Closet Stylist will make reasonable efforts to accommodate such requests where possible. However, where a client asks to accelerate, rearrange or otherwise alter the normal process, the client accepts that the recommendations provided at that stage may necessarily be based on the information available at that time.

Where a client requests an accelerated service but has not yet provided sufficient information about their personal taste, lifestyle, wardrobe or requirements, Capsule Closet Stylist cannot be held responsible for recommendations not fully reflecting preferences that have not been communicated.

Any interim or accelerated recommendations may subsequently be refined as further information becomes available.

A client’s request to accelerate or change the normal sequence of the service does not reduce the package price, create an entitlement to a refund or transfer responsibility for missing information to Capsule Closet Stylist.

Where a client chooses not to undertake a particular stage of the process at the recommended time, the service may be adapted accordingly, but Capsule Closet Stylist cannot be responsible for limitations in personalisation resulting from information or stages that the client has chosen to defer, omit or replace.

7. Client Satisfaction, Corrections and Cancellation After Work Has Commenced

Capsule Closet Stylist is committed to providing a professional and personalised service.

If a client identifies a genuine error or reasonably believes that a particular aspect of the service does not meet the agreed requirements, they should raise this promptly with Capsule Closet Stylist so that we have a reasonable opportunity to consider and, where appropriate, rectify the issue.

Where Capsule Closet Stylist identifies or accepts that a genuine mistake has been made and reasonably rectifies that mistake, the service will be considered to have been given the opportunity to be corrected and the client’s payment obligations will not automatically be reduced or cancelled as a result of the original error.

A client cannot cancel a package or withhold payment solely because an initial recommendation required clarification, refinement or reasonable correction where Capsule Closet Stylist has taken reasonable steps to address the issue.

Cancellation because the client changes their mind

Once bespoke work has commenced, a client’s decision that they no longer want the service, no longer wish to continue, have changed their mind, or are dissatisfied with the direction of the service does not, by itself, create an entitlement to a refund.

This includes where the client’s dissatisfaction results from expectations that were not communicated to Capsule Closet Stylist or from preferences which were not sufficiently represented in the information provided by the client.

The client remains responsible for payment for work already completed and time and resources reasonably committed specifically to their service.

Where the value of work completed and resources reasonably committed exceeds the amount already paid, the outstanding balance may remain payable, subject always to any statutory rights that cannot legally be excluded or restricted.

The fact that the client has not yet received every stage of a package does not mean that the work already undertaken has no value or that previous payments should automatically be refunded.

Capsule Closet Stylist may, at its discretion, agree to bring a package to an early end or offer a pause where appropriate. Any such arrangement will be confirmed in writing.

8. Pause of Service

If a client is unable or unwilling to continue with their styling package at a particular point, Capsule Closet Stylist may, at its discretion, offer the option to pause the package rather than terminate it.

A pause does not constitute cancellation and does not create an entitlement to a refund.

Unless otherwise agreed in writing, a paused package must be resumed and completed within the original 12-month service validity period.

Capsule Closet Stylist reserves the right to agree a different timeframe in writing where exceptional circumstances apply.

9. Exceptional Circumstances

Genuine mistakes, misunderstandings or exceptional circumstances will be considered on a case-by-case basis at the discretion of Capsule Closet Stylist.

Any goodwill resolution offered by Capsule Closet Stylist in an individual case does not create an obligation to provide the same resolution in future cases and does not amend these Terms and Conditions generally.

10. Feedback and Concerns

Clients are encouraged to raise any concerns about a particular stage, recommendation, appointment or deliverable as soon as reasonably possible and while the service remains ongoing.

Where a client has concerns about a particular deliverable or stage of the service, they should notify Capsule Closet Stylist within 14 days of receiving or completing that stage wherever reasonably possible, so that the matter can be considered and, where appropriate, addressed while the service is ongoing.

This 14-day period does not remove or restrict any statutory rights or remedies that cannot legally be excluded.

Raising a concern does not automatically entitle the client to a refund or cancellation of the package.

11. Appointment Cancellations and Rescheduling

If a client needs to cancel or reschedule an individual appointment, they should provide at least 48 hours’ notice.

Capsule Closet Stylist will make reasonable efforts to accommodate a new date and time, subject to availability.

Cancellations or rescheduling requests made with less than 48 hours’ notice may incur a £10 administration fee.

This appointment cancellation provision applies to individual appointments and is separate from cancellation of the overall styling package.

12. Booking Responsibility

Clients are responsible for scheduling their appointments in sufficient time to ensure that the relevant service can be completed within the 12-month validity period.

Availability is limited and cannot be guaranteed for last-minute requests.

Failure by a client to arrange or attend appointments, provide required information, complete requested exercises or otherwise participate in the service does not automatically extend the 12-month validity period.

13. Payment Plans and Recurring Payments

Where an instalment or payment plan is offered, the client is purchasing the complete styling package at the total price stated at the time of booking.

Payment by instalments is a method of spreading payment and does not mean that individual instalments purchase individual stages, documents, appointments or deliverables.

For example, where a package is priced at £1,200 and payment is agreed as three monthly instalments of £400, the client is purchasing the £1,200 package and not three separate £400 services.

The client’s payment-plan arrangement does not alter the scope, nature or total price of the package.

Where a client chooses to stop the service after it has commenced, the cancellation and refund provisions in these Terms and Conditions will apply.

Any payment-plan arrangements will remain subject to applicable consumer law and the specific payment terms accepted by the client at the time of purchase.

Where a client cancels or requests to terminate a package after work has commenced, the amount already paid will be considered against the work completed and resources reasonably committed to the client’s service. If the value of work completed exceeds the amount already paid, the outstanding balance may be payable.

Payment by instalments does not limit Capsule Closet Stylist’s entitlement to payment for work already completed.

14. Booking and Acceptance of Terms

Before purchasing a service, clients will be given access to these Terms and Conditions and the relevant information relating to the service being purchased.

By proceeding with a booking or payment, the client confirms that they have had the opportunity to read and understand these Terms and Conditions and agree to be bound by them, subject to any statutory rights that cannot legally be excluded.

Where a client is required to confirm acceptance of these Terms and Conditions through an online booking or payment process, that acceptance will form part of the booking record.

Capsule Closet Stylist recommends that clients retain a copy of these Terms and Conditions for their records.

15. Statutory Consumer Rights

Nothing in these Terms and Conditions is intended to exclude, restrict or limit any statutory rights or remedies available to a consumer under applicable UK law where such rights or remedies cannot legally be excluded or restricted.

Where applicable, services will be provided with reasonable care and skill and in accordance with applicable consumer legislation.

Where information provided by Capsule Closet Stylist about a service forms part of the contract under applicable law, that information will be treated accordingly.

DISPUTE RESOLUTION

If you and Capsule Closet Stylist are unable to resolve a complaint or dispute through good-faith communication, both parties agree to make a reasonable attempt to resolve the matter through appropriate Alternative Dispute Resolution or mediation before commencing court proceedings, where this is reasonably appropriate.

Nothing in this provision prevents a consumer from exercising any statutory right or remedy available to them.

RESPECTFUL COMMUNICATION

Capsule Closet Stylist expects all clients to communicate respectfully with Michelle and any representatives of the business.

Capsule Closet Stylist reserves the right to end communications or suspend further non-essential interaction where a client engages in abusive, threatening, harassing or otherwise unacceptable behaviour.

Nothing in this provision prevents a client from making a genuine complaint, review or report about their experience, or from exercising any statutory rights.

LAW AND JURISDICTION

These Terms and Conditions are governed by the laws of England and Wales.

Subject to any mandatory consumer rights regarding jurisdiction, any dispute arising from or relating to these Terms and Conditions or the services provided by Capsule Closet Stylist will be subject to the applicable courts of England and Wales.

CONSENT AND ACCEPTANCE

By booking or purchasing a service from Capsule Closet Stylist, and where applicable by confirming acceptance of these Terms and Conditions during the booking or payment process, you acknowledge that you have read and understood these Terms and Conditions and agree to them, subject to any statutory rights that cannot legally be excluded or restricted.

SEVERABILITY

If any provision of these Terms and Conditions is found to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed only to the extent necessary, and the remaining provisions will continue to apply.
